The three remaining members of Detroit rock legends, The MC5, are to be sued by the widow and children of MC5 lead singer Rob Tyner over rights to the group's recordings, compositions and the MC5 trademark.

Rob Tyner’s widow, Rebecca Derminer and her children with Tyner - son Robin Derminer and daughters Elizabeth Derminer and Amy Vallandi - have filed suit against Wayne Kramer, Michael Davis, Dennis Thompson and their related businesses. Tyner died of a heart attack in September 1991. The fifth member the MC5s, Fred (Sonic) Smith, died in 1994.

The remaining members of the band re-formed last year and spent lots of time doing stuff with Levi, as well as making weak and disappointing appearances at festivals such as Leeds and Reading.

Those whining "open letters" on the DKT-MC3 website are hilarious. Even funnier is that anyone would buy the argument that Wayne Kramer is once again a victim.

Wayne Kramer, who was part of a band that stood for freedom of expression, can't stand it when anyone criticizes him.

Here's someone who spoke out about the MC5 documentary "True Testimonial" that Wayne blocked -- Patti Smith, widow of Fred "Sonic" Smith, talking to Jim DeRogatis of the Chicago Sun-Times in a story that ran earlier this year:

Q. Let's switch gears: There's been quite a bit of controversy in Chicago between filmmakers David Thomas and Laurel Legler and the surviving members of the MC5, particularly Wayne Kramer, who are blocking the release of their film, "MC5: A True Testimonial." You were married to the late MC5 guitarist Fred "Sonic" Smith. Where do you stand on the issue?


A. I feel very sad about it. I haven't seen the film, but my son has seen it. He thinks it's great. He really wanted to see it come out. I mean, I've done everything
that I can legally do to help them. The MC5 era was before my time, so I know very little
about it, except that I hope that the filmmakers get a chance to distribute their film.

I don't have very much respect for Wayne Kramer as a human being, so I can't really make any judgment. I haven't found him to be an honorable person. I shouldn't comment on it because I haven't seen the film, but I take my son's word that it was good and good for his dad.

They were a great band and they should be remembered. And they should be remembered together. This film is a very good opportunity to give them recognition. I don't understand why he would want to block it except for monetary reasons. The only reason I haven't seen it is just it's hard for me to watch Fred. It's just painful.

Undoubtedly, I wouldn't go out and say that Kramer's the Archangel Gabriel and that he's 100% innocent. It seems fucked on both sides, both on Kramer's and on the side of the filmmakers. Just another band squabble eh? Even revolutionaries can't decide...

Wayne makes a big deal of his dispute with the filmmakers, but what about not paying the widows and children of your departed bandmembers what's due them?

It's the MCFIVE -- so the widows and children would be entitled to two/fifths of anything with the MC5 name on it. These are two very important band members who've passed on, and their names can't be said enough -- Rob Tyner and Fred "Sonic" Smith.

There is no MC5 without them.

Just quickly to say that I worked with Wayne Kramer for a short amount of time and I have no sympathy. He is a thief. Although I enjoyed the time I spent with him. Overall he took money from me and tried to claim the writing credit for songs that my band and I had writen.

Its really hard for me to take the new look MC5 seriously with two of it's focal points, Smith and Tyner are long dead....It's like Zeppelin without Page and Plant -
