They sampled a song by a guy called Lo-bat without permission and now the 8-bit community is up in arms.

They haven't actually sold the song. It's on a second myspace of theirs.

The problem with 8-bit music is that there are only a limited amount of sounds you can get from it. It would probably be wrong of CC to claim credit for that one noise.
Lo-bat
had a very distinct sound he made in the WAV channel of the gameboy sound chip.
So there's no way CC could have arrived at the same noise independently?
Obviously they could have.
Not without a few people thinking "Hey this sounds like a Lo-bat song, hang on it has the same melody as well!"

I've read that there's controversy surrounding that sample a swell.
The sample was a preset arpeggio...
...from a particular synth, so no-one can claim it as their own artistic property.
