A US radio presenter has accused the Red Hot Chili Peppers of plagiarism, claiming that the band's 'Dani California' single is near identical to Tom Petty's 'Mary Jane's Last Dance'.
Dan Gaffney, of Delaware-based WGMD, told his listeners of the similarities. Subsequently, the show's producer Jared Morris told reporters:
"The chord progression, the melody, the tempo, the key, the lyrical theme... they're identical."
To prove the point, Morris has posted MP3s on his personal blog, here. Neither Petty nor the RHCP are yet to comment.

By listening to both songs completely, you will hear two very different tales and get two very different images. Good music is good music.
The chili peppers have always paid respect to music as a language and a force in itself. They have devoted much of themselves to it. I hear many of the influences of the musical forefathers, in this album. It's a nice positive force for good. I can choose to be negative and thumb them for plagerism, or I could just appreciate the good music, it's my choice.

I have faithfully followed the Peppers since '87 when I first saw them at a college assembly hall. I was blown away. And I still am today. Flea, (obviously a moniker born of his height) used to almost exclusively slap his base as is the style of the harder punk/funk style of their roots. Recent albums put out by the Peppers show a maturation of style that you vitamin c deficient wastes of air and food seem to be unable to comprehend. Flea has changed his style in an obvious way if you are able to actually clean all the shit out of your ears and listen to the music. He incorporates much more to his playing than simply slapping the base around, he is playing complicated extended chords requiring plucking as well as the aforementioned thumb slapping. He is immensely talented and contributes in no small way to their enduring unique sound.
Now, to address this plagiarism thing, I won't deny the two songs sound similar, but the over feeling I get from each of these are decidedly different. Tom Petty has such a range of style that you would hardly know if let’s say you were from Mars and never heard of him that he was the same guy who wrote Free Fallin' or I Wont Back Down is the same as Mary Jane's Last Dance. (And yes, assholes, were just talking about the tunes here and not lyrics. 'cause who couldn't pick out Tom Petty's voice)So, my point is, if this great musician has such a broad style in his discography, does it not stand to reason that any band whose style is a bit more confined to specific genres may hit upon a similar single. I'm sure if you pathetic wannabes listen long enough you'll even find retarded people who sound like you.

I like some songs by Tom Petty. I like most songs on this Chili Peppers Album. It makes me happy. I choose to be happy. There is lot of negative, crappy stuff happening in the world, so rather than jump on the hypothesis of some American DJ looking for more attention for himself (with comparisons that were made long before he "discovered this outrageous plagerism") I choose to pay my hard earned money for a little silver circular disc that will play music in my cd player. The music makes me dance, it makes me happy, it fills me with some sort of good feeling. Believe me, I appreciate the good feelings.

So your just a fucking muppet son who needs to open your ears and start appriciating the bass that is in the chili peppers as it makes the music more exciting. you tit.

if you listen close and know anything about music, the journalist put flea's bass line and chad's drum part behind tom petty's intro, which in turn speeds up the tempo. the original tom petty song is slower. also, listen to the chords, they aren't exactly the same, they may be in the same key, but not the same. not to mention, the choruses are completely different and the singing style is different.
just some things you should have paid attention to before ripping on one of the best bands around.

3. Those bastards sped up the MJLD sample to match the tempo of DC
4. That sample isnt even the main hook of DC
5. The melody is nothing alike
6. The subject matter is nothing alike (DC is about a rebellious girl who dies, MJLD is about smoking roaches and then growing up)
7. The rhythm is a pretty standard southern rhythm.
basically, the similarities are minimal and those DJ's are just doing abit of promotionfor their station.

Plagarism Issue
Personally..I don't really think the Chilli Peppers plagarised and I don't think it even matters. As people have constantly said before, the songs have clear differences, and it could be entirely coincidental that they sound the same. How many other bands have songs that are extremely similar? There is really no such thing as originality any more, so don't rag on the Chilli Peppers for something every other band does. The song is still really good, they are still an amazing, amazing band. All of their songs have a certain element that makes them stand out, that makes them identifiable, and that's whats important right now, taking your influences and adding something special.
So shut up already.
